Sam joined Rose Litigation Lawyers in 2023 and is based in our Gold Coast office.
Sam was admitted as a solicitor in December 2021 after having completed a Bachelor of Laws (Honours) and a Bachelor of Arts (majoring in Politics and International Studies and Criminal Justice) at Griffith university.
Prior to joining Rose Litigation Lawyers, Sam was working at another prominent Queensland law firm specialising in commercial litigation. During her early career Sam worked at a top-tier firm within the alternative legal services team working on large scale class-actions.
Recent matter involvement
- Acted for the respondent formwork contractor in Niclin Constructions Pty Ltd v Yatala Formwork Pty Limited [2023] QSC 285 in resisting a complex interlocutory application for the hearing of separate questions to be determined in advance of trial. Read Decision Here
- Acted for respondents in Lingard v Commonwealth Bank Officers Superannuation Corporation Pty Limited [2024] FCA 174 in an appeal from a decision the Australian Financial Complaints Authority (AFCA) affirming decision of first respondent where the first respondent decided appellant was not a dependant and so was not entitled to any benefit from deceased member’s superannuation fund. - Successfully acted on behalf of a franchisor in a large-scale franchise dispute where a franchisee had breached multiple franchise agreements simultaneously. This matter was successfully mediated with all franchised stores being returned to the franchisor.
- Acted for the Queensland Building and Construction Commission in several proceedings seeking the recovery of debts pursuant to sections 71(1) and 111C of the Queensland Building and Construction Commission Act 1991 (Qld)
- Acted for the creditor in the successful winding up application (Supreme Court of Queensland Proceeding No. BS981/24) pursuant to section 459A of the Corporations Act 2001 (Cth) for a failure to comply with a statutory demand.
- Acted in a claim for negligence and/or unjust enrichment in relation to a deceased estate, settling the matter prior to the commencement of court proceedings.
- As well at the other matters above, I have been involved in a recent Royal Commission, a matter against the Commonwealth of Australia and other general commercial litigation matters.
